Guyana Trademarks
Guyana achieved independence from the United Kingdom on May 26, 1966 and became a Republic on February 23, 1970, remaining a member of the Commonwealth. The country is now called The Cooperative Republic of Guyana.
Guyana became a member of the CARICOM on August 1, 1973.
The legal system is based on English common law with certain admixtures of Roman-Dutch law.
The Trademarks Act of Guyana is applicable for trademark applications. Registration under the Trademarks Act protects the registered proprietor of the trademark from any action for infringement and entitles him to bring an action for infringement.
Guyana has no provision for registration of service marks. However, it is possible to register service marks in Guyana, only as an extension of a UK trademark registration.
Trademarks that are an extension of the UK Register can be registered by providing a certified copy of the UK Certificate of Registration.
International priority under the rules of the Paris Convention is not available.
No local use or intent to use is necessary prior to application but failure to use the trademark within a period of five years following registration may subject the mark to an action by an interested party for cancellation of the mark.
Registration of a trademark is valid for a period of 7 years and may be renewed for a further period of 14 years.
A trademark may be renewed at any time within three months before the date of its expiry. The Registrar may remove a trademark from the register where its proprietor has not renewed its registration in the manner prescribed. However, the trademark may be restored to the register.
