Antigua and Barbuda Trademarks Act
New Intellectual Property laws were adopted in December 2003: the Intellectual Property Act, the Trademarks Act, the Industrial Designs Act, the Copyright Act and the Patent Act.
The Trademarks Act of 2003 provides for the registration of service marks and registration with priority under the Paris Convention.
Registrations based on a UK registration are no longer required nor possible.
No local use or intent to use is necessary prior to application but failure to use the trademark within a period of three years following registration may subject the mark to an action by an interested party for cancellation of the mark.
Registration of a trademark is valid for a period of 10 years and may be renewed for a further period of 10 years.
